1. Introduction

The Feedbackers Ltd. and its affiliates (“Feedbackity”, “we”, “our” or “us”) takes the privacy and protection of personal information seriously. By visiting our website or using our services, you acknowledge and accept the practices and policies outlined in this Privacy Policy (the “Privacy Policy”). This Privacy Policy applies to all information collected from or about you by Feedbackity.
The purpose of this document is to help you understand what information is collected from or about you, how this information is used and protected, and what options you have with regard to this information.


2. Information Covered by this Policy

For purposes of this Privacy Policy, our use of the term “Information” means any and all information we receive from or about you. This may include (without limitation) information collected from you directly or indirectly, manually or otherwise, or via electronic, automatic or other means, including (without limitation) via stationary, mobile or any other devices. Such information may include information (i) which you provide during the course of your use of our website (the “Site”), or your use of our services or our platform (the “Services”); (ii) collected about you, your business, and the technology you are using, and (iii) which we receive about you from third parties or other sources.

Information is divided into two distinct categories:

  • “Non-Personal Information” means Information which does not personally identify a person.

  • “Personal Information” means Information related to a natural person that can be used to directly or indirectly identify the person, such as names, addresses, e-mail addresses, and phone numbers, as well as other non-public information that is associated with the foregoing.

We obtain and use Information in accordance with this Privacy Policy. We will ask for your consent before using Personal Information in a manner other than as set out in this Privacy Policy.

BY USING OUR SERVICES OR VISITING OUR SITE OR SUBMITTING INFORMATION THROUGH THE SERVICES OR VIA OUR SITE, YOU EXPRESSLY CONSENT TO THE COLLECTION, PROCESSING, AND USE OF YOUR INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY, INCLUDING THE COLLECTION, USE, DISCLOSURE, STORAGE, TRANSFER AND PROCESSING OF YOUR INFORMATION, INCLUDING YOUR PERSONAL INFORMATION, AS DESCRIBED HEREIN. YOUR INFORMATION, INCLUDING YOUR PERSONAL IDENTIFIABLE INFORMATION, MAY BE PROCESSED IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS IN OTHER COUNTRIES WHERE LAWS REGARDING THE PROCESSING OF INFORMATION, INCLUDING PERSONAL INFORMATION, MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.

4. How we Obtain and Collect Your Personal Information

You may provide us with your personal information voluntarily. However, we may also receive personal information about you from third parties such as marketing agencies, market research companies, our suppliers, contractors and consultants of our Affiliates, your colleagues and business contacts, public websites, and public agencies.

We collect Personal Information that you give us by filling in forms (including online forms, feedback forms after viewing a film or other creative work and/or forms completed for or at events), completing a customer survey or providing feedback on any of our message boards or via email, providing us with films or other creative works, using our Services, using or viewing our website, contacting us, setting up an account with us, registering online, placing an order for any of our products or services, or by contacting us by phone, email or other means; and that we learn about you from our business interactions, communications, and dealings with you.

We also collect Personal Information you communicate to other users of the Services or the Site through the Services or the Site. However, we are under no obligation to review, and assumes no responsibility or liability relating to, such communications.  In addition, we will track your usage of our Site and how you interact with our systems and Services.  In this regard, we may record your actions on the Site by creating a video file of how you use the Site and our Services.  We also collect Personal Information automatically when we receive and store certain types of information automatically when you interact with the Site or use the Services.

We may receive personal information from third parties, such as your colleagues or business contacts, that may believe our Services are relevant to you, or when you register for one of our events.  

We need certain types of personal information so that we can provide Services to you and perform contractual and other legal and regulatory obligations that we have. If you do not provide us with such personal information, or if you ask us to delete it, you may no longer be able to access our Services.

We, or third parties on our behalf, may collect and use the following personal information:

  • When you (or an organization that you represent) become(s) a customer and/or a user of our Services, we, or third parties on our behalf, may collect and use the following types of information: your first and last names; gender; date of birth; government-issued identification and/or number; photo identification; address; fax; country of residence; nationality; place of birth; country of birth; languages; profession; film preferences and genres; interests; your company and/or personal email address; your telephone number; your company name; your job title; your company’s industry; general information about your interest in our products and services; information about how you heard about us; personal information included in feedback you provide; PayPal details; information about films you submit or with respect to which you use the services (including without limitation film title, film synopsis, length, film link, film genre and any other information relating to your film, information of actors in your film and others who contributed to the film in any way); information provided when you correspond with us; any updates to information provided to us; information you provide to help us provide you with improved services; information about your marketing preferences, and personal information we collect about you or that we obtain from our third party sources.

  • Whenever you contact us or respond to our communications (e.g., in email, telephone, or writing), we receive your contact information and any other personal information you choose to provide us. We will use such information to fulfill your requests or to provide services.

  • We collect Personal Information when you use or request information about our Services, subscribe to marketing communications, request support, complete surveys, or sign up for and/or attend events we participate in.

  • Your communications with other users of the Services or the Site may be monitored, recorded and/or reviewed by Feedbackity.

In addition, the following information is created and recorded automatically when you visit our Site or use our Services:

  • Technical information, including the Internet protocol (IP) address used to connect your computer to the internet address; the website address and country from which you access information; the files requested; browser type and version; browser plug-in types and versions; operating system; and platform. We use this personal information to administer our Site, to measure the efficiency of our systems and to undertake an analysis on the locations from which people access our web pages; and

  • Information about your visit and your behavior on our Site or our Services. This may include the website you visit before and after visiting our Site (including date and time), time and length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, traffic data, location data, weblogs and other communication data and information provided when requesting further service or downloads. 

By using the Site and/or the Services you provide your consent to automated processing of your personal information.

You may only provide personal information of others who have granted you their explicit consent to provide such information, and you are responsible for notifying such third parties that you have provided their information and directing them to this Privacy Policy.

7. Non-Personal Information

Non-Personal Information may be collected, processed, and used in accordance with applicable law, for any and all purposes we deem fit. Generally, the information Feedbackity collects is used only for our own internal purposes, for example, to improve the Services and the Site, to improve our marketing and promotional efforts, to improve customer service, and to improve Feedbackity content and Site offerings, and may also be used by Feedbackity to contact you to provide you with information which we believe may be useful to you. Feedbackity believes that these uses allow it to improve the Services and our Site and to better tailor them to meet customers’ needs.

 


8. Use of Personal Information

In general, Personal Information you submit to us, or that is obtained by us, is used:

  • to process your order and manage your account,

  • to email you with offers to supply feedback,

  • to email you with special offers on other products and services we think you might like,

  • to email you with job offers,

  • to share it with the filmmakers who received feedback from you,

  • to locate suitable jobs for you,

  • to share it/your film with feedbackers,

  • to allow you to access and use our Site;

  • to receive inquiries from you through the Site about our Services and Site;

  • for improvement and maintenance of our Site and to provide technical support for our Site,

  • to ensure the security of our Site,

  • to enable us to watermark your email, telephone, IP and/or other identifying details on videos or other artistic works you view or download or otherwise are granted access to,

  • to recognize you when you return to our Site, to store information about your preferences, and to allow us to customize our Site according to your individual interests,

  • to evaluate your visit to the Site and prepare reports or compile statistics to understand the type of people who use our Site, how they use our Site and to make our Site more intuitive,

  • to run identity and know-your-customer checks and any other checks required by law and/or regulation,

  • work history/CVs

  • to enable us to receive and manage services from you (including supplier due diligence, payment and expense reporting and financial audits);

  • to assess your working capacity;

  • to confirm information on CVs and performance reference checks, to assess you or your employer’s suitability to work for us; 

  • for equal opportunities monitoring;

  • for health and safety records and management;

  • for security vetting and criminal records checks (where applicable and allowed by law); and

  • for CCTV monitoring and other security of company facilities.

  • to communicate with you about our Services,

  • to send you notifications regarding your use of the Services or the Site,

  • to send you notifications by various means, including regular mail, email, telephone, including voicemail, or SMS (text message)

  • to bill you, to resolve fee disputes and for other associated billing services,

  • to further new services or products,

  • to operate, maintain, and improve the features, functionality, and performance of our Site and Services,

  • to comply with our legal obligations;

  • to comply with our regulatory obligations;

  • to enhance security, prevent fraud or market abuse, monitor and verify identity or service access, combat spam or other malware or security risks;

Furthermore, we may create anonymized information from Personal Information by excluding information that makes the information personally identifiable to you. We may use this anonymized information for internal purposes, such as analyzing usage patterns, so that we may enhance the Site and Services, and we also reserve the right to use and disclose such anonymized information at our discretion to third parties. Such anonymized information may be deemed to be Non-Personal Information and used accordingly.

 


9. Disclosure of Personal Information

9.1 Non-Disclosure of Personal Information to Third Parties.  

Except as otherwise stated in this Privacy Policy, we will not disclose or share your Personal Information with third parties, unless you ask or authorize us to do so.

 


9.2 Disclosure of Personal Information.

We may disclose your Personal Information to our subsidiaries, joint ventures and to other companies under common control (collectively, “Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. We may provide your Personal Information to your employer and to your colleagues within the organization that you represent. We may provide your Personal Information to any legal, regulatory or governmental body that we are required to disclose information to, as well as to credit control and debt collection agencies. 

In addition we may provide your Personal Information to business partners, sub-contractors, companies that assist us in our marketing, advertising and promotional activities, analytics and search engine providers that assist us in the improvement and optimization of our Site, third party service providers, and suppliers who work on our behalf 

    • to provide you with some of the Services or the Site (and in the case of feedbackers as part of your provision of feedback services), 

    • to operate, improve, understand, customize, and support the Services or the Site, 

    • to help us communicate with our customers, 

    • to assist us in our marketing, advertising and promotional activities 

    • to assist us in the improvement and optimization of our Services or our Site and “

    • to help us with our business and informational needs. 

However, we do not grant these business partners, service providers, and suppliers any independent right to use this information except to help us provide the Services, operate the Site, or for our legitimate business interests.

In the event Feedbackity goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information will likely be among the assets transferred. You acknowledge that such transfers may occur, and that any acquirer of Feedbackity, or a portion or all of its assets may continue to use your Personal Information as set forth in this Privacy Policy.

We may disclose Personal Information we have collected from and about you if we believe in good faith that such disclosure is necessary (a) to comply with relevant laws, (b) to respond to court orders, subpoenas, or warrants served on us, (c) to respond to an emergency, or (d) to protect and defend Feedbackity’s rights or property.

Please note that third parties you interact with, including your employer, may have their own privacy policies, and Feedbackity is not responsible for their operations, including, but not limited to, their personal information practices. Personal Information collected by third parties, which may include contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

 


9.3 Disclosure of Content, Feedback, and Related Personal Information Provided through the Site or Services

One of the main purposes of the Services is for users of the Services to provide content to be reviewed (“Content” and “Content Providers”) and for other users to provide feedback to Content (“Feedback”). 

Content may include (i) film or other creative content, including Personal Information included therein, (ii) information regarding a film or other creative content, such as film language, country, genre, synopsis and film length and (iii) additional submissions and information provided along with or relating to such Content, including Personal Information.  A Content Provider may also provide information relating to the Content Provider and its associates, such as (i) the name, age, gender and country of the Content Provider and his associates and content collaborators and (ii) any additional Personal Information shared on the company’s sign-up form in a section allowing such Content Provider to provide information describing himself or its associates and content collaborators (“Content Provider Information”).

Feedback may include (i) critique, information, suggestions and any other form of feedback relating to the Content, and Personal Information included within such Feedback, and (ii) any other information, including Personal Information, which the provider of Feedback (“Feedback Provider”) includes on any feedback forms or other submissions relating to the Feedback.  Feedback may also include information relating to the Feedback Provider, such as (i) the first name, age, gender, country and profession of the Feedback Provider and (ii) any other information which a Feedback Provider shares on the company’s sign-up form in a section allowing such Feedback Provider to provide information describing himself (“Feedback Provider Information”). 

 

If you are a Content Provider, we may disclose to Feedback Providers the Content and the Content Provider Information, including Personal Information of the Content Provider and his associates included therein, and you hereby provide your consent to our providing such Personal Information to Feedback Providers.  If you are a Feedback Provider, we may disclose to Content Providers and to other Feedback Providers the Feedback and the Feedback Provider Information, including Personal Information included therein, and you hereby provide your consent to our providing this Personal Information to Content Providers and to other Feedback Providers. 

Subject to any limitations set forth in our Terms of Use, Feedback and Feedback Provider Information [(and Content and Content Provider Information, to the extent permitted in accordance with the Terms of Use)], and Personal Information included therein, may be shared by us on our Site, on third party websites, on social media, in conferences, public viewings, trade shows or through other public media or in any other public manner, for any purpose, including (i) as part of the provision of our Services, (ii) to promote or market our Services or our Site, and (iii) to improve and/or showcase our Services. 

Therefore, if you are a Feedback Provider you should assume that your first name, age, gender, profession and any other information that you provide as part of such Feedback or Feedback Provider Information, including any Personal Information you elect to disclose and provide as part of such Feedback or Feedback Provider Information will be made available to the Content Providers, to other Feedback Providers, and to others with whom we or such Content Provider shares such information.  

Do not include your Personal Information in Feedback and Feedback Provider Information that you provide if you do not want us or a Content Provider to disclose such Personal Information to others.  

By providing the Feedback and Feedback Provider Information you expressly grant your consent to such Content Provider and to us to publish such information in whatever manner he or we wish, including as part of public reviews, media publications, third party websites, marketing materials, through third parties or otherwise. Similarly, if you are a Content Provider, you understand and agree that any information included in Content or the Content Provider Information, including any Personal Information you elect to disclose and provide as part of such Content, may be viewed and downloaded by third parties, including Feedback Providers.  Do not include your Personal Information in Content and Content Provider Information that you provide if you do not want us to disclose such Personal Information.  

Notwithstanding the foregoing, you agree not to make any unauthorized use of the Personal Information of any other party obtained by you in connection with your use of the Site or Services.

Feedback Providers agree not to use any Content or Content Provider Information, including any Personal Information included therein, except for purposes of provision of the Feedback, and not to disclose any Content or Content Provider Information, or any other Personal Information to any third party.

Content Providers agree not to use or disclose Personal Information included in Feedback or Feedback Provider Information except for legitimate purposes related to the Feedback or the Content, such as the improvement, promotion, commercialization or exhibition of the Content or the Feedback. 

 

You understand and acknowledge that Feedbackity is not responsible for the actions of any user of the Site or Services, including any Feedback Provider or Content Provider, and you understand the risks associated with the inclusion by you of Personal Information in Feedback or Content. You are responsible for any use you make of the Personal Information of any other user of the Site or the Services.  

 


9.4 Public Postings to the Site or Services

If you post information or content on our site or services, such as reviews of the site or other information posted on message boards, chat, profile pages and blogs, and other services to which you are able to post information and materials (other than Content provided by a Content Provider in the manner explicitly instructed by the terms of the Site or Services so as to keep such Content confidential), such content may be made available to third parties and on third party websites. Any Personal Information you may choose to disclose and include in such content may also be included within materials distributed by our partners.

We may provide you with the ability to anonymously post certain comments, in which case we will not include your contact information (i.e., name, username, email address, or your employer) on the Site in connection with such comments. However, you should know that our internal records may associate your contact information with such comments.

 


10. Retention of Your Personal Information

Our Company securely stores your data. We currently store your data at Paperfrom.co, Mailchimp, WordPress Database, Google GSuite, Gravity forms, and on work computers. We may also store your data via additional third party providers. Only people working at Feedbackity or for Feedbackity have access to the data. All accounts are password protected.

We keep your Personal Information for as long as is necessary for the purposes for which the Personal Information is processed. The length of time for which we retain Personal Information depends on the purposes for which we collect and use it and/or as required to comply with applicable laws and to establish, exercise or defend our legal rights.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve these purposes through other means, and the applicable legal requirements.

Where we receive sensitive personal information, we will only keep such information for as long as strictly necessary.

We make reasonable attempts to ensure that all instances of such information (e.g. production, backups, etc.) are deleted in their entirety, including any of your personal information upon deletion.

11. Data Transfers

We may transfer the Information, including Personal Information, we collect about you to recipients in countries other than the country in which the information originally was collected, including but not exclusively, countries outside the European Economic Area (“EEA”), and such information may be used, stored and/or accessed in such locations. Those countries may not have the same data protection laws as the country in which you initially provided the information. By using or participating in any of our Services or the Site, and/or by providing us with your Information, you consent to the collection, transfer, storage and processing of your Information in such other countries, including countries outside of the EEA. In those cases where we transfer Personal Information collected in the EEA to Affiliates or to our service providers located in countries outside the EEA, we will take appropriate measures to ensure that the recipient protects your Personal Information adequately in accordance with this Privacy Policy. These measures may include entering into European Commission approved standard contractual arrangements designed to ensure that your Personal Information is protected.

 


12. Legal Bases for Our Use of Your Personal Information

We rely on your consent and/or our legitimate business interests as the legal bases for processing Personal Information.

Our legitimate business interests include:

(a) to perform our or a third party’s obligations under any contract with you; 

(b) to comply with our legal obligations (for example, complying with our legal and regulatory obligations); 

(c) to protect the vital interests of the data subject or of another natural person; 

(d) to further our legitimate interests or the legitimate interests of others (for example, to run, grow and develop our business; operate our Site; provide the Services; select appropriately skilled and qualified feedbackers or other suppliers; select and categorize films or other creative works for effective use of our Services; marketing, market research and business development; provide efficient and effective Services to our customers; make and receive payment and provide customer services; place, track and ensure fulfilment of orders with our feedbackers or other suppliers; for internal group administrative purposes; and to ensure the security of our Site or Services). 

If we rely on our (or another person’s) legitimate interests for using your Personal Information, we will undertake a balancing test to ensure that our (or the other person’s) legitimate interests are not outweighed by your interests or fundamental rights and freedoms which require protection of the Personal Information.

If we rely on your consent for us to use your Personal Information in a particular way, but you later change your mind, you may withdraw your consent by contacting us at the e-mail address set forth in the “Contact Us” section below, and we will stop doing so.

 


13. Links to Other Websites

The Services and/or the Site may contain links to other websites that are not owned or controlled by us. The provision of such links does not signify our endorsement of such websites or their content. We have no control over, do not review and are not responsible for, the privacy policies, terms of use, or content displayed on such other websites, nor for the information collected, used or stored through such other websites. Please be aware that the terms of our Privacy Policy do not apply to any outside websites.

 


14. Security and Confidentiality

Feedbackity has put in place commercially reasonable protections and procedures to safeguard and secure the Personal Information we collect. However, even with these measures, we cannot guarantee the security of Personal Information. Furthermore, Feedbackity cannot guarantee the security of other types of sensitive information which are provided through the use of the Site, the Services or otherwise, including  commercially sensitive information, such as movies, videos, or other artistic or commercial works (“Sensitive Information”). There is a risk that Information, including Personal Information and/or Sensitive Information, may be lost, stolen or misused.  This could lead to your Personal Information and/or Sensitive Information being in the hands of someone else who may use it fraudulently or make public information that you would prefer to keep private. Furthermore, in the course of the provision of your Personal Information and/or Sensitive Information to us, your Personal Information and/or Sensitive Information may be transferred over the internet.  The transmission of information over the internet is not completely secure. As such, you acknowledge and accept that we cannot guarantee the security of your Personal Information and/or Sensitive Information transmitted to our Site and that any such transmission is at your own risk. By using our Services or our Site, you acknowledge and agree that we make no guaranty with respect to the security and confidentiality of your Personal Information and/or Sensitive Information.

 


15. Access to, Correcting or Deleting Your Personal Information

If we hold Personal Information about you, you may request that we correct, amend, or delete certain information where it is inaccurate, within reason and in accordance with applicable laws. Prior to fulfilling any request for information or deletion, we may require you to provide information so that we may verify your identity. Subject to applicable laws, we reserve the right to decline requests that are unreasonable, present risk to the privacy of another individual, may jeopardize the confidentiality of another party, are excessively repetitive, may require significant technical modifications to our systems. 16. Your Rights with Respect to Your Personal Information

EU data protection law makes a distinction between organizations that process personal information for their own purposes (known as “Data Controllers”) and organizations that process personal information on behalf of other organizations (known as “Data Processors”).

California residents under age 18 who are registered users of any of our services geared toward this age group may ask us to remove content or information that you have posted to our website or related platforms by contacting us using the information in the ‘Contact details’ section below. Please note that your request does not ensure complete or comprehensive removal of the content or information, as, for example, some of your content may have been reposted by another user.

We will consider all such requests set forth in this Section 16 and provide our response within a reasonable period (and in any event within one month of your request unless we tell you we are entitled to a longer period allowed by applicable law). Please note, however, that certain Personal Information may be exempt from such requests in certain circumstances, for example if we need to keep using the information to comply with our own legal obligations or to establish, exercise or defend legal claims.
